Comparative Study on Conflicts of Interest

This study compares tools for the prevention of conflicts of interest for elected representatives of the people at the national, regional and local level, for members of the government and senior representatives of central administrative bodies in the Czech Republic and nine other countries (France, Croatia, Italy, Canada, Germany, Norway, Poland, Austria and Spain).

The individual instruments are compared from the point of view of content, complexity and enforceability of the legal regulation with an emphasis on practical operation and identification of good practice.

The regulation prohibiting the simultaneous performance of certain public functions, the incompatibility of the functions with the economic activities of public officials and the transitional period consisting in the prohibition of the performance of certain activities after the end of the public function are compared. Furthermore, the study deals with the reporting obligations of public officials and the level of transparency regarding their legal and property status.

The comparative study was made as part of the project Intensification of the fight against corruption by raising awareness of the public sector with a focus on judges, law enforcement authorities and public administration financed from the financial mechanism of the EEA Funds 2014–2021 within the framework of the Proper Administration program, which was prepared by the Ministry of Justice of the Czech Republic.
